In Gutierrez v. California Commerce Club, Inc., ___ Cal.App.4th ___ (Aug. 2, 2010; pub. ord. Aug. 28, 2010), the Court of Appeal (Second Appellate District, Division One), reversed an order dismissing class allegations at the pleading stage. Gutierrez is a wage and hour case for missed meal periods and rest breaks.
