On Tuesday, March 30, 2010, the Supreme Court denied review and depublication in In re Vioxx Class Cases, no. S179699. Justice Chin was recused and did not participate.
Vioxx is one of the nine Court of Appeal cases to date substantively interpreting Tobacco II. Here is my original blog post on the opinion (the post is very short), in which the Court of Appeal affirmed an order denying class certification. In re Vioxx Class Cases, 180 Cal.App.4th 116 (Dec. 15, 2009).
Review petitions are still pending in Weinstat and Steroid Hormones. None appear to have been filed in McAdams or Pfizer yet. The deadlines in those cases have not yet passed.
