Last week, I attended the oral argument in Harris v. Superior Court (Liberty Mutual Insurance), no. S156555. In Harris, the Court of Appeal reversed the trial court's order decertifying the plaintiff insurance adjusters' overtime claims, which were predicated on the adjusters' alleged misclassification as exempt from the overtime laws.
I did not think that any of the justices' questions were particularly illuminating. The class certification issues were not really discussed at all. Justice Liu's scholarly bent was evident from his questions.
Laura Ernde of the Daily Journal had a different take. Her headline described the justices as "skeptical of overtime for insurance adjusters." Either way, we'll know in 90 days.
