As you've probably already heard, last week the Supreme Court scheduled oral argument in Brinker Restaurant Corp. v. Superior Court, no. S166350. The argument will take place on Tuesday, November 8, 2011 at 9:00 a.m. in San Francisco.
While the Brinker case is best known for the substantive Labor Code issues it raises relating to meal periods and rest breaks, the case also involves some class certification questions that could impact California class actions more broadly, depending on how the questions are decided. See this blog post for more on those questions.
The briefs are available on my Brinker page. Recently, the workers filed a supplemental brief under Rule of Court 8.520(d) addressing Martinez v. Combs, 49 Cal.4th 35 (2010).
