New UCL "unlawful" prong decision: Lu v. Hawaiian Gardens Casino, Inc.

In Lu v. Hawaiian Gardens Casino, Inc., ___ Cal.App.4th ___ (Jan. 22, 2009), the Court of Appeal (Second Appellate District, Division Three) held that claims for violation of certain Labor Code provisions could proceed under the UCL's "unlawful" prong, even though the provisions themselves carred no private right of action.  Slip op. at 11.
