Ninth Circuit vacates UCL standing and preemption opinion: Degelmann v. Advanced Medical Optics Inc.

On October 30, 2012, the Ninth Circuit vacated its opinion in Degelmann v. Advanced Medical Optics Inc., 659 F.3d 835 (2011), which addressed UCL standing after Kwikset (among other issues). My original blog post on the opinion is here.

I have heard, but have not confirmed, that the action settled while a petition for en banc rehearing was pending.  The Ninth Circuit not only vacated the opinion, but also dismissed the appeal.
