U.S. Supreme Court hears oral argument today in class arbitration case: American Express Co. v. Italian Colors Restaurant

Today at 10:00 a.m. Eastern, the U.S. Supreme Court will hear oral argument in American Express Co. v. Italian Colors Restaurant, No. 12-133.  This case involves whether an arbitration clause is enforceable under federal law if it interferes with the effective vindication of statutory rights.  The Second Circuit said no.  In re AmericanExpress Merchants’ Litig., 667 F.3d 204 (2nd Cir. 2012).
